ThaVibes Terms of Service

Welcome to ThaVibes, a cutting-edge platform dedicated to fostering a vibrant global community of creators and audiences through innovative content creation, streaming, events and  monetization tools. By accessing or using the ThaVibes services (including our web and mobile applications, AI-powered tools, digital wallets and  any associated features), you signify your agreement to be bound by these Terms of Service (“Terms”). Please read them carefully, as they define your rights, obligations and  responsibilities while using our platform. If you do not agree, you must not access or use the Services.

These Terms incorporate by reference our Privacy Policy, Community Guidelines and  any other applicable policies or legal notices published by ThaVibes. In the event of any conflict, these Terms control.

  1. Introduction

ThaVibes provides a diverse suite of services designed to empower independent content creators to share, monetize and  collaborate on original work while connecting audiences worldwide. Our platform leverages 2026-era technologies, including advanced generative AI, secure digital transactions and  immersive content delivery, all while complying with evolving global regulations such as the EU AI Act, updated data protection laws (e.g.  GDPR, CCPA/CPRA) and  intellectual property frameworks. By using our Services, you agree to comply with these Terms, which govern your access to and use of the platform, its features and  any updates or modifications.

  1. Description of Services

ThaVibes offers tools and features for creators and consumers, including:

  • Content Streaming: Creators can upload and share a wide variety of original content—such as films, music, live streams, short-form videos and  emerging formats (e.g.  immersive VR/AR experiences where supported)—for global discovery and on-demand or live streaming. Consumers can browse, stream, interact with and  enjoy content from independent creators worldwide.
  • Event Management and Ticket Sales: Creators may host virtual, hybrid or in-person events, sell tickets and  manage attendance via our integrated marketplace, subject to applicable local laws and venue requirements.
  • Monetization through Donations and Subscriptions: Fans can directly support creators via monetary donations, subscriptions or other fan-funding tools. ThaVibes charges a transparent transaction fee (detailed in our Help Center or at checkout) to sustain platform operations.
  • AI-Driven Creator Tools: To drive creativity and efficiency, ThaVibes provides state-of-the-art generative AI tools for content ideation, enhancement, editing, personalization and  recommendation. These tools comply with emerging AI regulations, including transparency and labeling requirements under the EU AI Act and similar frameworks. Outputs generated via these tools are owned by the user (subject to the license granted below) but users are responsible for ensuring compliance with all laws.
  • Digital Wallets and Transactions: Secure digital wallets enable users to store, send and  receive funds (including supported fiat and cryptocurrency options where legally available). These facilitate seamless, autonomous transactions while incorporating robust fraud prevention and regulatory compliance (e.g.  anti-money laundering rules).

Additional features may be added over time and will be governed by these Terms unless otherwise specified.

  1. Content Licensing and Intellectual Property Rights

Creators retain ownership of their original content (“User Content”). By uploading, streaming or otherwise making User Content available on ThaVibes (including any AI-generated or AI-enhanced material created with our tools), you grant ThaVibes a perpetual, irrevocable, non-exclusive, royalty-free, worldwide, sublicensable and  transferable license to host, reproduce, distribute, display, perform, promote, market, monetize and  otherwise use the User Content in connection with the Services and our business operations. This includes using User Content (anonymized where required by law) to train, improve and  operate our AI models, recommendation systems and  platform features, while adhering strictly to applicable privacy, data protection and  copyright laws (including opt-out mechanisms where mandated).

You also grant other users a non-exclusive license to access and interact with your User Content as enabled by platform features (e.g.  streaming, sharing or embedding).

For AI-generated Outputs: You own the Output produced using ThaVibes AI tools (to the extent permitted by law) but the same license applies. You must not represent AI-generated content as entirely human-created if doing so would violate laws or our Community Guidelines. ThaVibes may apply watermarks, metadata or labels to AI Outputs for transparency and regulatory compliance (e.g.  EU AI Act Article 50 requirements).

ThaVibes respects intellectual property rights and expects the same from all users. You warrant that you have all necessary rights, licenses and  permissions to upload or share any User Content and that it does not infringe third-party rights. Unauthorized use, reproduction or distribution of content is prohibited. We employ automated systems to detect potential infringement, spam or violations. Repeat infringers may have their accounts terminated in accordance with applicable law.

  1. User Eligibility and Account Security
  • Eligibility Requirements: You must be at least 13 years of age (or the minimum age required in your jurisdiction) to create an account and use the Services. For features involving monetization, payments or certain AI tools, you must be at least 18 years old or the age of majority in your jurisdiction. Users under the age of majority may use the Services only with the supervision and consent of a parent or legal guardian, who agrees to be bound by these Terms and assumes responsibility for the minor’s activities.
  • Account Ownership and Responsibilities: The account creator is the “Account Owner” and is solely responsible for maintaining the confidentiality of login credentials, passwords, payment information and  any linked digital wallets. You are responsible for all activity under your account. You must provide accurate, current information and update it promptly.
  • Security Measures: ThaVibes implements industry-leading security, including encryption, two-factor authentication (or advanced options such as biometric verification where available) and  AI-assisted threat detection. You are encouraged to enable all available security features. Immediately notify us of any suspected unauthorized access or breach. We may suspend or terminate accounts to protect platform integrity.
  1. User Conduct and Community Guidelines

The Services are intended primarily for personal, non-commercial use by individuals, though creators may use them for legitimate monetization as expressly permitted. You are granted a limited, non-exclusive, non-transferable license to access and view content solely for personal enjoyment. Public performances, commercial exploitation outside the platform or unauthorized redistribution are prohibited.

You agree to comply with all applicable laws, our Community Guidelines and  these Terms. Prohibited conduct includes (but is not limited to):

  • Uploading or sharing illegal, harmful, offensive, defamatory, harassing or infringing content.
  • Generating, sharing or promoting unlabeled AI-generated or manipulated content (including deepfakes) in ways that violate transparency laws, mislead users or cause harm (e.g.  election interference or misinformation).
  • Circumventing security, interfering with AI safety features or using the Services for spam, fraud or unauthorized data collection.
  • Impersonation, manipulation of metrics or any activity that disrupts the platform or community.

ThaVibes maintains a respectful, inclusive community. We reserve the right to review, moderate, remove or label content (including via automated and human processes) and to suspend or terminate accounts for violations, in compliance with applicable law (including notice where required in certain jurisdictions).

  1. Geographic Restrictions and Content Availability

Content availability is subject to licensing agreements, local laws, export controls, sanctions (e.g.  OFAC) and  regulatory requirements. The Services may not be accessible in certain regions or to sanctioned individuals/entities. Specific content or features may be geo-restricted and subject to change.

Streaming quality depends on your location, device, bandwidth and  network conditions. ThaVibes aims for optimal delivery and recommends minimum speeds of 5 Mbps for HD and 25 Mbps for Ultra HD/immersive content (higher for VR/AR where available). You are responsible for any data or internet charges.

  1. Account Management, Payments and  Digital Wallets

You are responsible for maintaining accurate payment and wallet information. ThaVibes uses state-of-the-art encryption and compliance protocols for all transactions. We may suspend services for invalid or outdated details.

Transaction fees are clearly disclosed. All payments (donations, ticket sales, etc.) are final unless otherwise stated. You must review your transaction history regularly and report issues promptly. ThaVibes reserves the right to restrict or terminate accounts involved in fraud, unauthorized activity or violations of payment regulations. Digital wallet features support secure transfers and comply with applicable financial and anti-money-laundering laws.

  1. Warranty Disclaimer and Limitation of Liability

The Services (including all AI tools and Outputs) are provided “AS IS” and “AS AVAILABLE” without any warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement or accuracy of AI-generated content. ThaVibes does not guarantee uninterrupted access, error-free operation or that AI Outputs will be unique, factual or suitable for any purpose. Users are solely responsible for evaluating and using AI Outputs and for complying with all legal obligations (including labeling requirements).

To the fullest extent permitted by law, ThaVibes, its affiliates, officers, directors, employees and  agents shall not be liable for any indirect, incidental, special, consequential or punitive damages (including loss of profits, data or goodwill) arising from your use or inability to use the Services. Aggregate liability is limited to the greater of (a) the amount you paid ThaVibes in the prior 12 months or (b) USD $100. These limitations do not apply to liability that cannot be excluded by law (e.g.  gross negligence or willful misconduct in certain jurisdictions). You agree to indemnify ThaVibes against claims arising from your User Content, AI use or violations of these Terms.

  1. Dispute Resolution and Arbitration

Any dispute arising out of or relating to these Terms or the Services will be resolved through binding arbitration on an individual basis (not class or representative actions), except for small claims court matters or where prohibited by law. Arbitration will be conducted under the rules of a mutually agreed neutral provider. You and ThaVibes waive any right to a jury trial or class action. Disputes will be resolved individually.

Pre-arbitration informal resolution is encouraged. These Terms do not waive any statutory consumer protections available in your jurisdiction.

  1. Amendments and Modifications

ThaVibes may update these Terms at any time to reflect technological advancements, legal changes (e.g.  new AI regulations) or platform evolution. Material changes will be notified at least 30 days in advance via email, in-app notice or platform posting. Continued use after the effective date constitutes acceptance. If you do not agree, you must stop using the Services.

  1. Miscellaneous Provisions
  • Governing Law: These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws principles. Any disputes not subject to arbitration will be resolved exclusively in the courts of Delaware.
  • Unsolicited Submissions: ThaVibes does not accept unsolicited ideas or pitches and assumes no responsibility for similarities to its own content or features.
  • Severability: If any provision is held invalid, the remainder remains in full effect.
  • Entire Agreement: These Terms, together with the Privacy Policy, Community Guidelines and  other published notices, constitute the full agreement.
  • Electronic Communications: You consent to receive all notices, updates and  communications electronically.
  • Assignment: ThaVibes may assign these Terms in connection with a merger, acquisition or sale of assets.
